WHAT TO DO IF I HAVE HAD A SLIP AND FALL?

What to Do After Slip and Fall

A slip and fall is what it sounds like; you’ve slipped and fell on someone else’s property whether public or private. For instance, in the winter time many slip and falls happen because of uncleared ice or slush.

HOW DO I KNOW THEY ARE AT FAULT?

Like any personal injury claim, your lawsuit boils down to who is liable and how much are they at fault. It is often the case where the injured victim will be held partially liable for the fall if, for example, they were wearing high heeled shoes or running at the time. Additionally, premises can limit their liability if they provided the necessary warning signs such as a “Wet Floor” clapboard. With that said, just because you may be partially at fault does not negate your claim for damages altogether. A good personal injury lawyer will be able to diminish your responsibility for the incident and put as much blame as possible on the owner of the premises.

I HAVE BEEN INJURED FROM A SLIP AND FALL—WHAT SHOULD I DO IMMEDIATELY?

First and foremost, make sure your health is looked after and call an ambulance if your injuries are anywhere close to serious. It is important to manage your injuries and get the care you need before even thinking about anything else. If an ambulance is called, it is important you explain in great detail how you have fallen and indicate every ounce of pain and injury you are feeling.

Once your health is taken care of, and you are out of harms way, attempt to get an incident report if the circumstances allow for it. Most establishments will have documentation for these incidents and be sure to get a copy of what has been recorded.

Be sure then to follow-up with a local walk-in clinic, ER or your family doctor. Many injuries and forms of treatment are time sensitive and therefore it is imperative that you don’t shrug off the pain but rather seek the medical attention you need. Follow your doctor’s orders and participate in your recovery.

Lastly, contact a personal injury lawyer at your earliest opportunity.
