HOW DO DOG AND ANIMAL BITE CLAIMS WORK

According to the Dog Owners’ Liability Act in Ontario, the owner of a dog is liable for damages resulting from a bite or attack by the dog on another person or domestic animal. The act states, in section 2 subsection (3), “The liability of the owner does not depend upon knowledge of propensity of the dog or fault or negligence on the part of the owner, but the court shall reduce the damages awarded in proportion to the degree, if any, to which the fault or negligence of the plaintiff caused or contributed to the damages”. In other words, an animal owner for instance will be liable for the damages caused by their animal. If the injured victim instigated the attack to some degree by say taunting, teasing, or hurting the animal than that may diminish some amount of the damages.

DEFENSES TO DOG AND ANIMAL BITE CASES

Sometimes, not always, an owner with a vicious animal might not be held liable for an attack by their animal. This may be the case, if the owner of the animal properly warned other people that the animal was dangerous, and took measures to keep the animal away from people. Therefore, people have a duty to take notice of such warning and act accordingly, avoiding the forewarned danger.
